1. Definitions
This Data Processing Addendum ("DPA") supplements the 1Labs.ai Terms of Service and applies when 1Labs Inc. ("1Labs," "we," "our") processes Personal Data on your behalf as part of providing AI product development, automation, and related services.
All capitalized terms used in this DPA have the meanings defined under applicable data protection laws, including the General Data Protection Regulation (GDPR).
2. Scope and Roles
This DPA governs the processing of Personal Data by 1Labs acting as a data processor on behalf of you, the data controller.
We will process Personal Data solely in accordance with your documented instructions and in compliance with all applicable data protection laws and regulations.
3. Data Processing
When processing Personal Data on your behalf, 1Labs will:
- Process Personal Data strictly in accordance with your written instructions
- Ensure that authorized personnel are bound by confidentiality obligations
- Implement appropriate technical and organizational measures (TOMS) to safeguard Personal Data
- Assist you in responding to data subject access requests, corrections, deletions, or objections
- Notify you without undue delay of any Personal Data breach
4. Sub-processors
1Labs may engage third-party sub-processors to support service delivery, including hosting, infrastructure, and AI tooling providers.
We ensure that all sub-processors:
- Are bound by written agreements imposing data protection obligations equivalent to those in this DPA
- Maintain security and confidentiality standards consistent with GDPR requirements
A current list of sub-processors may be provided upon request.
5. Data Transfers
If Personal Data is transferred outside the European Economic Area (EEA) or other applicable jurisdictions, 1Labs will ensure that adequate safeguards are in place, including:
- Standard Contractual Clauses (SCCs) approved by the European Commission
- Additional security and compliance measures where required
We will not transfer Personal Data internationally without lawful mechanisms in place.
